Terms of Service

Please read these terms carefully before using the Ignite Auctions platform. By creating an account or placing a bid, you accept these terms in full.

Agreement Summary: Ignite Auctions provides an online marketplace for curated auction lots. These Terms govern your access to and use of our platform. Our Auction Rules govern the specific conduct of bidding and transactions and are incorporated into these Terms by reference.

1. Acceptance of Terms

By accessing or using the Ignite Auctions website, mobile application, or any related services (collectively, the "Platform"), you agree to be legally bound by these Terms of Service ("Terms"), our Auction Rules, and our Privacy Policy.

If you do not agree to all of these Terms, you must immediately cease using the Platform. If you are using the Platform on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

Age Requirement: You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you meet this requirement.

2. Platform Access

Ignite Auctions grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your personal or internal business purposes in accordance with these Terms.

Service Availability

We strive to maintain continuous availability of the Platform but do not guarantee uninterrupted access. The Platform may be unavailable during scheduled maintenance, emergency outages, or circumstances beyond our control. We will endeavour to provide advance notice of planned downtime where possible.

Geographic Restrictions

The Platform is operated from Zambia and is intended for users in jurisdictions where participation in online auctions is lawful. It is your responsibility to ensure that your use of the Platform complies with all laws applicable in your jurisdiction.

3. User Accounts

Registration

To access bidding features, you must create a verified account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.

Account Security

  • You are solely responsible for maintaining the confidentiality of your login credentials.
  • You must not share your account with any third party.
  • You must notify us immediately at security@igniteauctions.com if you become aware of any unauthorised use of your account.
  • All activity conducted through your account - including bids placed - is your responsibility, whether or not authorised by you.

Account Types

Individual and corporate bidder accounts are available. Corporate accounts require additional documentation as set out in our Auction Rules. Seller accounts are available by invitation and separate agreement only.

4. Auction Transactions

All auction transactions conducted through the Platform are governed by our Auction Rules, which are incorporated into these Terms by reference. The following additional terms apply:

Binding Nature of Bids

Every bid you submit constitutes a legally binding offer to purchase the lot at the bid amount plus applicable buyer's premium and taxes. Bids cannot be retracted except as expressly provided in the Auction Rules.

Platform Role

Ignite Auctions acts as agent for the seller. We are not a party to the sale contract between buyer and seller, except where we are acting as seller in our own right. We are not responsible for the accuracy of lot descriptions provided by third-party sellers, though we take reasonable steps to verify them.

Taxes

You are responsible for determining and paying all taxes applicable to your purchases. Ignite Auctions will collect and remit taxes only where legally required to do so.

5. Prohibited Use

You agree not to use the Platform for any purpose that is unlawful or prohibited by these Terms. Without limiting the foregoing, you must not:

  • Engage in shill bidding, bid rigging, or any form of market manipulation.
  • Use automated systems, bots, or scrapers to interact with the Platform without our written consent.
  • Attempt to gain unauthorised access to any part of the Platform or its systems.
  • Transmit any content that is defamatory, offensive, or infringes any third-party rights.
  • Use the Platform to launder money or finance any unlawful activity.
  • Circumvent, disable, or interfere with any security-related features of the Platform.
  • Collect or harvest any personally identifiable information from other users.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Solicit other users to engage in transactions outside the Platform.
Enforcement: Violations may result in immediate account suspension, forfeiture of bids, civil claims, and referral to law enforcement authorities.

6. Intellectual Property

All content on the Platform - including but not limited to text, graphics, logos, images, lot photography, software, and data compilations - is the property of Ignite Auctions or its licensors and is protected by applicable intellectual property laws.

Permitted Use

You may view and print content from the Platform solely for your personal, non-commercial use in connection with participating in auctions. No other use is permitted without our prior written consent.

User Content

If you submit any content to the Platform (such as reviews or images), you grant Ignite Auctions a worldwide, royalty-free, perpetual licence to use, reproduce, and display such content in connection with operating the Platform. You represent that you have all rights necessary to grant this licence.

Lot Photography

All lot images are provided for identification purposes only. Copyright in the artwork depicted remains with the respective rights holders. Publication or reproduction of lot images requires separate clearance from the rights holder.

7. Privacy & Data

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the Platform, you consent to the data practices described in our Privacy Policy.

Key Points

  • We collect identity, contact, and transaction data necessary to operate the Platform and comply with legal obligations.
  • We share data with payment processors, logistics partners, and regulatory authorities where required.
  • We retain transaction records for a minimum of 7 years in accordance with applicable laws.
  • You have the right to access, correct, and (in certain circumstances) request deletion of your personal data by contacting privacy@igniteauctions.com.
  • We implement industry-standard security measures including 256-bit encryption for data in transit.
GDPR / Data Protection: If you are based in a jurisdiction with applicable data protection legislation, your rights under that legislation are preserved. Contact our Data Protection Officer at dpo@igniteauctions.com.

8. Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Ignite Auctions does not warrant that:

  • The Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
  • Lot descriptions, estimates, or condition reports are free from error or omission.
  • Any particular lot will achieve any particular price.
  • Transactions will be completed successfully in all cases.

Lot condition reports and specialist opinions are provided in good faith as guidance. They are not warranties and do not constitute a guarantee of authenticity or condition except as expressly stated in our Authenticity Guarantee under the Auction Rules.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IGNITE AUCTIONS, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or business opportunity.
  • Losses arising from your reliance on Platform content or third-party lot descriptions.
  • Any amounts in excess of the total fees paid by you to Ignite Auctions in the 12 months preceding the claim.

Some jurisdictions do not allow certain limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Ignite Auctions and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from:

  • Your use of the Platform in violation of these Terms.
  • Your violation of any third-party right, including intellectual property rights.
  • Any false or inaccurate information you provide to the Platform.
  • Your failure to pay for a lot you won at auction.

11. Termination

Ignite Auctions may suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason including but not limited to breach of these Terms.

You may close your account at any time by contacting support@igniteauctions.com, provided you have no outstanding payment obligations or active bid commitments.

Effect of Termination

  • All pending bids placed by a terminated account are immediately void.
  • Outstanding payment obligations survive termination and remain legally enforceable.
  • Provisions of these Terms that by their nature should survive will continue in effect after termination, including Sections 6, 8, 9, 10, and 13.

12. Amendments

We reserve the right to modify these Terms at any time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Send registered users an email notification at least 14 days before the changes take effect.
  • Display a prominent notice on the Platform for 30 days following the change.

Your continued use of the Platform after the effective date of any amendment constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must close your account before the effective date.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Zambia, without regard to its conflict of law provisions.

Any legal proceedings arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of Zambia, save that Ignite Auctions may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent breach of these Terms.
